Help?
Heres my dilemma....
I park in an underground garage, and theres piping all above. The pipe that I park under, started leaking shit onto my car.
I thought no biggie, I'll wipe it off and tell the super to fix it.
I look later and it stained my car...
I ran it through a car wash, tried scrubbing it myself and none of it works. Its like its stained permanently.
I called the super and bitched and said someone is going to pay for the damage to my car and she said its not her problem and that, that is what insurance is for.
So my question to you guys is....
1. Whos problem is it to deal with this?
2. Can I get the stains buffed out or something? If so, how much would it roughly run me?

My friend had exact same thing happen to his TL. It was fucking calsium build up. Went to my friends body shop he wrote up a quote (around 400). Then he he went to the dealer to get a quote, that was 3 times my friends quote. He brought both quotes to the building maneger, never even said one word just got a check a week later for $400.

Under the Landlord and Tenant Act of Ontario, the landlord is responsible for keeping the property in a manner that does not damage yours. I had the same problem with a landlord 2 years ago. Our driveway had a big tree above it that dripped sap onto my car. I had to have it buffed out, which cost quite a bit. I took him to the Landlord Tenant Board and he was forced to pay for the buffing, and was also ordered to trim the tree.

I believe your problem would fall under the T6 Maintenance Application, but you can call to find out for sure.

Call Ty at Elite Auto Salon (416-302-8418)< tell'em Dave with the red lancer sent ya, explain it to him and im sure they can get it dealt with... theyve dealt with some nasty shit... City of Toronto Street cleaners, snow removal equiptment and melters... but also lambos, ferraris.. so and theyre mobile, so they can do it while ur working or whatever..

damn that sucks. im pretty sure the super needs to pay for the damages. its their fault for not fixing a pipe leak.

FML... Since I reported it to the super, I think she had it fixed already... so when I came back and said someone needs to pay for it, she said call insurance cuz its not her problem.

Sorry to hear that.
You basically have 2 options.
Go after the building yourself to cover the cost of repairs or go through insurance and have the insurance company go after the building for repairs.
If you go through insurance you will be subject to your deductible… $300, $500, etc. It is obviously submitted as a comprehensive claim and the effect it has on your premium is ultimately up to your insurance company. I doubt it will make your premium increase… but I can’t say for sure. Basically if you go through insurance the insurance company has to prove negligence on the building and subrogate them to pay for the repairs. If they are successful, your insurance company will refund you for the deductible you paid.
Personally, I would go through insurance. I would get quotes and see how much the repair costs. Submit the claim and let the insurance company handle the hassle of going after the building.

from the looks of it, you gotta pay for it urself regardless. so why not just let her have a taste of your frustration. at least you get even with that bitch

all u need is to be able to show that the building's poor piping caused the damage, then you won't have to pay to get it fixed.

I'm gonna try to make the building pay for it cuz my deductible is less than the repair cost so either way I'm screwed unless they pay for it.
And if all else fails.. DOWN WITH THE SUPER'S CAR!

Get this at work all the time.
The building is responsible for the damage caused. F the super and go strait to building management and report it. Their insurance company will have to cover the damage done. But you have to show some kinda proof im sure.

You could still try going thru the Landlord Tenant board. It might scare them into paying before it even went to trial.

You still need to go to your own insurance company to report the claim... your own insurance company fixes your own vehicle not the other insurance company.
Your insurance company will then go after the building to compensate them for the damages and if successful you will get your deductible back.
